California’s Safe Drinking Water and Toxic Enforcement Act, commonly known as ‘Proposition 65’, requires that the State of California maintain a list of chemicals that are known to cause cancer, birth defects, and/or reproductive harm, and prohibits any business with 10 or more employees from ‘knowingly and intentionally’ exposing any person in California to a listed chemical without first giving a ‘clear and reasonable’ warning. Under Proposition 65, a warning must be given unless a business can demonstrate that exposure is low enough to pose no significant risk of cancer or is significantly below levels observed to cause birth defects or other reproductive harm. Therefore, a Proposition 65 warning means one of two things: (1) the business has evaluated the exposure and has concluded that it exceeds the “no significant risk level”; or (2) the business has chosen to provide a warning simply based on its knowledge about the presence of a listed chemical, without attempting to evaluate the exposure.

With respect to our products, the exposure may be below the Proposition 65 level of concern, or could even be zero.
